Course Objectives

Today, globalisation is the major driving force for changes not only in the economy but also in the law itself. Within EU countries, the content of domestic social policies is increasingly shaped by common rules established at the EU level having the effect of regulating - or deregulating - national labour markets.
The course offers students an invaluable opportunity to gain the necessary tools to understand EU social dynamics and to address the implications of globalization for the legal regulation of the workplace.
They are equipped with the essential legal skills that enable them to appropriately use the EU legal discourse, that represents an essential feature for today’s internationalized legal world and an invaluable instrument for resolving disputes related to labour issues.

Course Content Summary

The course is focused on selected objectives of the EU social policy and their relationship with the overall economic goals of the EU, with specific emphasis on the rationale and impact of EU social choices in the complex landscape of the global economic system.
The introductory part of the course provides students with the necessary background to understand the reasons behind crucial steps undertaken by the European legislator in the social field, the common rules relating to the establishment of the internal market and the legal method used by the European Court of Justice to achieve European integration. The course is then covering core aspects of the EU social project with a critical assessment of their effect through selected case study.

Detailed Description of Assessment Methods

The final exam is paper based. Students are required to work in groups and provide a reasoned opinion on a mock case as they were playing the role of Advocate General before the European Court of Justice.
